How's and Why's of Workplace Harassment Regulations
Among other things, this presentation will explore the practical realities and considerations that employers need to know about the pending Occupational Health and Safety Workplace Harassment Regulations. While the concept of psychological well-being in the workplace is not a new concept to many provincially-regulated workplaces, it has never before been mandatory. But as of July 1, 2020, it will be mandatory. Topics covered during this presentation include the types of conduct covered by the Regulations and how this conduct may extend beyond what we previously thought of as "harassment;" working from existing harassment/respectful workplace policies to ensure compliance with the regulations,;obligations related to training of workers and management; investigations; the role that the Occupational Health and Safety Division of the Workers Compensation Board will play in oversight and enforcement.
About our Presenters:
Stephen Carpenter
Stephen is the Senior Legal Advisor to the WCB PEI. Prior to transitioning in-house to WCB PEI in March 2019, Stephen was a partner in the Labour/Employment Group at Stewart McKelvey, where he practiced for close to 15 years in all areas of labour and employment law, workplace human rights, and workers compensation. He has appeared in all levels of court, has participated in numerous arbitrations and other administrative hearings and workplace investigations.
Stephen holds his CPHR (Certified Professional in Human Resources) designation and is also a Certified Workplace Investigator. Stephen also obtained his Q. Arb. (ie. Qualified Arbitrator) Designation, and has other Alternative Dispute Resolution training. Recently he became certified as a Workplace Psychological Health and Safety Advisor.
Stephen is a frequent speaker for clients and industry groups and associations on a range of workplace topics.
Danny Miller
Danny has been the Director of Occupational Health and Safety with the Workers Compensation Board for the past 5 years. After graduating from the University of Prince Edward Island in 1987 with a BBA, he began his career with the Workers Compensation Board in 1988. Over the past 32 years, he has held various positions within the Workers Compensation Board, covering areas of compensation, strategic planning, policy development, and freedom of information and the protection of privacy legislation.
Danny is a member of the CSA Group OHS Strategic Steering Committee as well as the Vice-Chair of the Canadian Association of Administrators of Labour Legislation’s Committee on Occupational Health and Safety (CAALL-OSH).
